Antimonopoly Committee Approved Recommendations on Calculating Fines for Violation of Legislation in the Sphere of Protection of Economic Competition

On September 15, the Antimonopoly Committee of Ukraine (AMCU) approved the Recommended Clarifications regarding Calculation of Fines for Violation of Legislation on Protection of Economic Competition, and the Chamber welcomes this substantial progress in increasing the transparency of functioning of AMCU, compliant with EU requirements and advocated by the Chamber.

At the same time, the proposals of the Chamber were accepted partially and some elements of the document need further improvement. We hope that current document will be a subject to review and other proposals of the Chamber will be introduced in future, ensuring even more transparency in calculating fines.

The Chamber also supported the Draft Law #2431 “On Amendments to Legislation on Protection of Economic Competition regarding Calculation of Fines for Violation of Legislation on Economic Competition by Antimonopoly Committee of Ukraine”, also aimed at bringing more transparency to the functioning of the AMCU and will continue its efforts in future.

We would like to thank experts of Arzinger for their active involvement in lobbying activities on this issue.
