Antimonopoly Working Group Meeting regarding Chamber Antimonopoly Roadmap


On November 15, the Chamber held its regular Antimonopoly Working Group meeting devoted to finalization of the Draft Chamber Antimonopoly Reform Roadmap, in particular, its parts devoted to the introduction of compliance system, control over public procurements and procedural aspects of investigations by the Antimonopoly Committee of Ukraine.

In terms of compliance, it was decided that unified approach to consideration of existence of compliance program in the context of calculating fine would be beneficial for business. In regard to control over public procurement, it was noticed that it is rather institutional capacity of the Committee than its authorities should be increased in view of improving efficiency of this function. Regarding procedural aspects of investigation, it was decided to keep initial version of the Roadmap.

Among other issues, several Draft Laws were discussed. In particular, it was discussed how recently passed Draft Law #4287 will be possibly applied by the Antimonopoly Committee of Ukraine once it enters into force. Meeting participants were also encouraged to provide feedback regarding Draft Laws #6723 and #6746, recently passed by the Verkhovna Rada of Ukraine in the first reading.
