Antitrust Compliance Workshop "Lessons from AMCU Decision against a Pharmaceutical Producer and Two of Its Ukrainian Distributors"


Meeting was organized jointly with its Member Company Sayenko Kharenko and devoted to frank and open dialogue about the compliance steps that businesses must take in order to mitigate risks from competition law enforcement.

The objective of the Meeting was to discuss the case with the Antimonopoly Committee of Ukraine (AMCU) having imposed a fine on the Ukrainian subsidiary of the pharmaceutical producer Sanofi and two of its Ukrainian distributors, which fundamentally changes the approaches to defining lawful market behaviour in vertical relations. The novel approaches of the AMCU question the promotion instruments, which allegedly limit the ability of domestically produced goods to compete with more expensive branded products. This change in the enforcement practice of the AMCU unquestionably requires immediate attention of compliance officers of major international and local companies involved in promotion and distribution of goods in Ukraine.
